Have any exemptions from standard customs procedures been introduced for products deemed necessary to combat the COVID-19 outbreak?
Yes^[1]. The plenary session of the Foreign Trade Committee (COMEX) through Resolution 004-2020 established in Annex 1 the products that due to the sanitary emergency will have 0% of importation tariff rate.

What exemptions do these measures provide?
The importation of products and supplies that will help fight against the coronavirus pandemic will have 0% of importation tariff rate.

What products are covered by these measures?
The National Customs Service of Ecuador, through bulletin 17-2020^[2] has established the list of products, which are:

• Surgical caps
• Protective glasses for work
• Surgical masks
• Examination gloves
• Surgical scrubs
• COVID-19 rapid test – reagents
• Alcohol stamped sheet
• Disposable laryngoscope
• Ozone therapy, oxygen therapy or aerosol therapy devices
• Revival breathing devices and other respiratory therapy devices
• Catheter
• Needle for arterial / venous fistula
• Bandages
• Bacterial / viral hygroscopic filter
• Surgical gloves
• Container for Sharp objects
• Security glasses
• Disinfectant (sodium hypochlorite)
• Potassium monopersulfate
• Carbopol
• Quaternary ammonium disinfectant (with subheading 3808.94.19.00)
• Quaternary ammonium disinfectant (with subheading 3808.94.99.00)
• Filmarray PCR Rapid Test Breathing Panels
• Reagents (coronavirus)

Is there an expiration date for these measures?
This measure was taken according to the state of sanitary emergency that the country is going through, so it is expected that it will no longer be valid once the state of emergency has been overcome. Until now, the measures are maintained until August 14.

Have the customs authorities adopted any measures to assist traders more generally with current customs procedures?
Yes. The Ecuadorian Standardization Service – INEN, streamlines the import process of various medical supplies such as: resuscitation respiratory devices, respiratory therapy devices, raw material for the production of antibacterial gel for domestic, sanitary or medical use, protective glasses, masks, among others.

In this sense, INEN users must follow an easy and quick process, detailed below:

1. Enter the Ecuapass system.
2. Verify through the tariff subheadings whether or not the product requires an INEN Certificate of Recognition.
3. Verify that the product is within the scope of the RTE (Technical Regulation).
4. Evaluate the product in accordance with the corresponding RTE INEN technical regulation.
5. It is evaluated as a product not subject to control with technical sheets and invoice.
6. INEN approval is issued (INEN Recognition Certificate)

In case of not complying with any premise of the Technical Regulation, it is corrected so that the user makes the correction to his request. Immediately corrected, the INEN recognition certificate is issued.

It is important mention that users and / or importers must have complied with the corresponding customs procedures with the National Customs Service of Ecuador – SENAE to nationalize their merchandise^[3].

¿Se han implementado exenciones tributarias para la importación productos necesarios para combatir el COVID-19?
Si. [1]El pleno del Comité de Comercio Exterior mediante Resolución 004-2020 estableció en el Anexo 1[2] los productos que por razón de la emergencia sanitaria tendrán tarifa arancelaria 0%.

¿En qué consisten estas exenciones?
La importación de productos e insumos que ayuden a combatir la pandemia del coronavirus se encontrarán con 0% de arancel de importación.

¿Cuáles son estos productos?
El SENAE ha publicado, mediante su boletín 17-2020[3] el listado de estas mercancías, que es el siguiente:

• Gorros quirúrgicos
• Gafas protectoras para el trabajo
• Mascarillas quirúrgicas
• Guantes de examinación
• Bata quirúrgica
• Prueba rápida por PCR para virus – reactivos
• Lámina estampada en alcohol
• Laringoscopio desechable
• Aparatos de ozonoterapia, oxigenoterapia o aerosolterapia
• Aparatos respiratorios de reanimación y demás aparatos de terapia respiratoria
• Catéter
• Aguja para fístula arterial/venosa
• Apósitos
• Filtro higroscópico bacteriano/viral
• Guantes quirúrgicos
• Contenedor para objetos cortopunzantes
• Gafas de seguridad
• Desinfectante (hipoclorito de sodio)
• Monopersulfato de potasio
• Carbopol
• Desinfectante amonio cuaternario (con subpartida 3808.94.19.00)
• Desinfectante amonio cuaternario (con subpartida 3808.94.99.00)
• Paneles respiratorios para prueba rápida por PCR Filmarray
• Reactivos (coronavirus)

¿Cuánto durará esta medida?
Esta medida fue tomada de acuerdo con el estado de emergencia sanitaria que atraviesa el país, por lo que se espera que la medida ya no sea válida una vez superado el estado de excepción. Es decir, por el momento, se mantienen las medidas hasta el 14 de agosto.

¿Se han implementado facilidades para los importadores?
Sí. El Servicio Ecuatoriano de Normalización – INEN, agiliza el proceso de importación de varios insumos médicos tales como: aparatos respiratorios de reanimación, aparatos de terapia respiratoria, materia prima para la producción de gel antibacterial de uso doméstico, sanitario o médico, gafas protectoras, mascarillas, entre otros.

En este sentido, los usuarios del INEN deberán realizar un proceso fácil y rápido, detallado a continuación:

1. Ingresar al sistema Ecuapass:
2. Verificar a través de las subpartidas arancelarias si el producto requiere o no Certificado de reconocimiento INEN.
3. Verificar que el producto esté dentro del campo de aplicación del RTE (Reglamento técnico).
4. Evaluar el producto de acuerdo con el reglamento técnico RTE INEN correspondiente.
5. Se evalúa como producto no sujeto a control con fichas técnicas y factura.
6. Se emite la aprobación por parte del INEN (Certificado de Reconocimiento INEN)

En caso de no cumplir con alguna premisa del Reglamento Técnico se subsana para que el usuario realice la corrección a su solicitud. Inmediatamente corregido se emite el certificado de reconocimiento INEN.

Es importante señalar que los usuarios y/o importadores deberán haber cumplido con los trámites aduaneros correspondientes con el Servicio Nacional de Aduana del Ecuador – SENAE para nacionalizar su mercancía[4].
